Overview:
Marc has represented bankruptcy trustees, individual and commercial creditors (including banks, landlords, and manufacturing companies), debtors and other parties in consumer and commercial bankruptcy cases, adversary proceedings and contested matters in the United States Bankruptcy Court cases for thirty-years. Representative experience includes:
- Prosecution of 100+ adversary proceedings involving, among other things, state and federal avoidance claims, real and personal property recovery, lien avoidance, fraud and breach of fiduciary duty claims, declaratory relief, discharge issues, state probate law, state real and property law, state and federal exemption law, state community property characterization and liability law, UCC matters and numerous types of other legal issues;
- Prosecution of a large number and range of contested matters involving, among other things, dismissal and conversion issues, exemption objections involving real property, motor vehicles, boats, cash and other personal property; emergency and non-emergency motions for turnover of funds, contested discovery issues and show cause matters;
- Prosecution of hundreds of claims objections involving secured, priority, administrative and unsecured claims including, but not limited to, omnibus claim objections, tax claims of varying types, wage claims, and general unsecured claims asserting contractual or tort-based claims under state law; and
- Provision of transactional services to trustees (from initial investigation to closing) involving, among other things, sales (by auction and private treaty) of commercial and residential real property, motor vehicles, boat and planes, commercial/industrial equipment, machinery and tools, claims and causes of action, interests in incorporated and unincorporated entities, intellectual property and negotiable instruments.
